Leave outside the rules

 

A Leave Outside the Rules application is usually made under Human Rights or under the Private Life Route.

There are circumstances which may be considered such as:

  • If you have been in the UK illegally for a period of 20 years, then you can make application on the basis of living in the UK. You must be able to show that you have sufficient evidence for each year to show you have been living in UK.

  • You may be granted leave to remain in UK under a human rights basis for instance on medical grounds.

 

If visa is granted under Leave Outside the Rules, then the applicant will obtain 2.5 years visa and then after this time period can renew for another 2.5 years. Once 10 years legal stay has been completed in the UK then each applicant will be eligible to apply for indefinite leave to remain in the UK.
